Help to Sell (Assisted Move) Terms and Conditions
• You will complete a Help to Sell application form with a member of our team.
• Vivly Living will commission an independent estate agent to provide an open market valuation of your existing property. The valuation will contain a price they feel your home will sell for and a recommendation on an initial advertising price.
• The estate agent will submit their valuations directly to Vivly Living for us to put together a marketing plan for the property and this will be discussed with you at a personal appointment on site. • Once a marketing plan is agreed with you, you will formally accept a place on the Help to Move scheme for the fixed time period referred to in your agreement.
• You will terminate any existing estate agency agreements, settle any outstanding invoices, if appropriate, and not instruct another estate agent during the period of the Home Mover agreement without the express agreement of Vivly Living.
• Vivly Living will not be responsible for fees arising from agreements or contracts with estate agents or any other parties entered into prior to the agreement or entered into at any time without our express consent. Neither will Vivly Living be responsible for fees arising from any dual liability in respect of previous or current agreements with estate agents.
• You must advise Vivly Living of any offers or interest you have received for your property prior to entering into the agreement or during the period of the agreement.
• Vivly Living will choose which estate agent will be instructed to market your property and will provide those instructions directly. The terms of those instructions will be solely at Vivly Living’s discretion.
• The estate agent will require you to sign their terms and conditions authorising them to advertise your existing home for sale.
• The Help to Sell scheme will be managed by Vivly Living who will keep in regular contact with you and the estate agents. We will agree action plans with you and in turn the estate agents will take instructions directly from Vivly Living.
• Vivly Living will pay the estate agents’ sales fees and any agreed marketing expenses on completion of your purchase of your new Vivly Living home.
• You agree to allow reasonable access to your property for viewings and survey purposes and to co-operate fully with the estate agents in their endeavours to market and sell your property.
• You will maintain the property and gardens of your existing home until completion of the sale.
• Upon agreeing a sale of your existing property, you will be invited to complete your reservation on an available new Vivly Living home.
• If you do not complete your reservation or progress to completion of your purchase of your new Vivly Living home, then you will be responsible for the estate agents’ fees as documented in their terms and conditions.
• By signing the agreement, you are confirming you have read and understood these Terms and Conditions and have had the opportunity to ask questions.
These Terms and Conditions do not affect your statutory rights.
